Latinos Asegurados Terms of Use
These Terms of Use apply in connection with any websites, online services, and/or applications owned or operated by Sherpa Digital LLC, doing business as Latinos Asegurados ("we," "us," or "our"), including, without limitation:
- the website currently located at [YOUR-DOMAIN] and any other website owned by us upon which these Terms of Use are linked (collectively, the "Site"); and
- any other interactive features, products, services, and resources offered by us and/or our affiliates through, and all other content within, the Site (all of which are collectively referred to as the "Services").
1. General Provisions
THESE TERMS OF USE TOGETHER WITH THE PRIVACY POLICY AND ANY SUPPLEMENTAL TERMS, CONDITIONS, OR RULES POSTED TO A SPECIFIC AREA OF THE SITE/SERVICES (COLLECTIVELY, "TERMS") SET FORTH THE LEGALLY BINDING TERMS GOVERNING YOUR USE OF THE SITE AND SERVICES.
By entering the Site or using the Services, you acknowledge and agree to all terms, conditions, and rules stated in these Terms. You are not permitted to use the Site or Services if you do not agree to be legally bound by these Terms. Please read these Terms carefully.
We may, in our sole discretion, modify these Terms from time to time, and we reserve the right to make changes at any time, without notice or obligation, to any of the Terms, Site, or Services. By continuing to use the Site or Services, you agree that you shall be bound by any such revisions as of the moment they are made. We suggest periodically revisiting this page to review these Terms.
2. Jurisdiction and Governing Law
By entering the Site or using the Services, you acknowledge and agree that they are intended for use only by citizens and residents of the United States of America residing within the United States, aged 18 years or older, and will be governed according to the laws of the State of Florida without regard to conflicts of laws principles. If you do not meet these criteria, you are prohibited from accessing the Site or using the Services.
We may assign our rights and obligations under these Terms, including in connection with a merger, acquisition, sale of assets, or by operation of law.
3. Content
The Site/Services provide you with information about final expense insurance products and connect you with insurance agents, insurers, and third-party insurance service providers (referred to herein as "Insurance Partners") who may be able to provide insurance products. If you are an insurance agent, insurer, or Insurance Partner, you may use the Site to obtain information about consumers interested in insurance products. All such information is referred to herein as "Content." Although we make reasonable efforts to ensure Content is correct and up to date, we cannot and do not guarantee 100% accuracy. WE DISCLAIM, TO THE FULLEST EXTENT PERMITTED BY LAW, ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, REGARDING THE SITE AND CONTENT.
If you are a consumer seeking insurance: please be aware that Latinos Asegurados is not an insurance company or an insurance agent. We help connect individuals with companies that may be able to provide insurance products. We do not charge consumers to submit inquiries; instead, we receive payment from the Insurance Partners with whom we connect you. We do not endorse or recommend any particular insurance agent, insurer, or Insurance Partner, nor any particular insurance product. We do not provide insurance, tax, or financial advice of any kind. We do not guarantee that any Insurance Partner with whom we connect you will contact you, offer you coverage, or honor any advertised rate or discount. We do not control and are not responsible for any communications between you and any Insurance Partner.
4. Account Security
If the Site/Services allow you to create an account, you must provide accurate and complete registration information and keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately if you believe your account has been accessed without authorization.
5. Consent for Communications
If you provide your telephone number to us via the Site or Services, you give your electronic signature and consent for Latinos Asegurados to send you marketing calls and text messages at that number, including using an autodialer and/or prerecorded or artificial voice messages. Your consent to receive these marketing communications is not required to purchase any goods or services. Standard message and data rates may apply.
If you consent to be contacted by our Insurance Partners — meaning the insurance agents, insurers, and other third parties with whom we may share your information to generate quotes — you give your electronic signature and consent for those Insurance Partners to also contact you by call or text at the number you provide, including using an autodialer and/or prerecorded or artificial voice messages, for marketing purposes. This consent is not required as a condition of purchasing any goods or services.
You may revoke consent to be contacted at any time by contacting us at santiago@sherpadigitalagency.com, though this will not automatically revoke consent you separately gave directly to an Insurance Partner — you must contact that Insurance Partner directly to revoke consent given to them.
Call Recording. You understand that calls to or from Latinos Asegurados, including calls transferred to licensed agents, may be monitored or recorded for quality review and analysis. By using our Site, you consent to this recording and agree to obtain the consent of any other individual who may be recorded on a call to or from Latinos Asegurados. Call recordings may be stored and analyzed for an indefinite period.

You agree not to sell, license, rent, modify, distribute, copy, reproduce, reverse engineer, publicly display, publish, or create derivative works from the Site, Services, or Content, except as expressly authorized. You may print or download information from the Site for your own personal, non-commercial use, provided you keep intact all copyright and proprietary notices. Systematic retrieval of information from the Site to create or compile a collection, compilation, database, or directory without our written permission is prohibited.
7. Digital Millennium Copyright Act Notice
If you believe material on the Site infringes your copyright, please contact our designated agent at santiago@sherpadigitalagency.com with: your signature; identification of the copyrighted work claimed to be infringed; identification of the allegedly infringing material and its location on the Site; your contact information; a good-faith statement that the use is not authorized; and a statement under penalty of perjury that the notice is accurate.

The Site may let you submit material to us — for example, a quote request, a message, or a testimonial ("Submissions"). We are not responsible for the content of Submissions and make no warranties about their accuracy. We reserve the right, but have no obligation, to refuse, remove, or edit Submissions.
By making a Submission, you represent that: you own it or have the right to submit it; it does not infringe any third party's rights; it is not illegal, obscene, defamatory, or otherwise inappropriate; and it does not identify any individual under 18 without appropriate consent.
You grant us an irrevocable, worldwide, royalty-free license to use, reproduce, distribute, and display your Submissions for our business purposes, including marketing. Submissions are not confidential; do not submit anything you expect to remain private.
9. Disclaimers & Limitation of Liability
YOU USE THE SITE AND SERVICES AT YOUR OWN RISK. THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, SERVICE PROVIDERS, AND LICENSORS DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO REPRESENTATIONS ABOUT THE AVAILABILITY, ACCURACY, OR COMPLETENESS OF CONTENT ON THE SITE, INCLUDING QUOTE ESTIMATES, WHICH ARE ILLUSTRATIVE ONLY AND NOT A GUARANTEE OF ACTUAL RATES, COVERAGE, OR ELIGIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL HAVE NO LIABILITY FOR: (A) ERRORS OR INACCURACIES OF CONTENT; (B) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SITE; (C) UNAUTHORIZED ACCESS TO YOUR PERSONAL OR FINANCIAL INFORMATION; (D) INTERRUPTION OF TRANSMISSION TO OR FROM THE SITE; OR (E) ANY LOSS OR DAMAGE RESULTING FROM YOUR USE OF THE SITE OR SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM USE OF THE SITE/SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED FIVE DOLLARS ($5.00).
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability; some of the above may not apply to you. To the extent we cannot lawfully disclaim a warranty or limit our liability, the scope of that warranty and our liability will be the minimum permitted under applicable law.
10. Indemnity
You agree to defend, indemnify, and hold us, our affiliates, service providers, employees, and agents harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Site/Services.
11. Dispute Resolution
Any dispute arising out of or related to these Terms, the Site, or the Services (a "Dispute") shall be resolved as follows. If the parties cannot resolve a Dispute informally, either party may initiate binding arbitration by providing written notice to the other. The arbitration shall be conducted under the rules of the American Arbitration Association applicable to consumer (or commercial, if you are a business) arbitration, before a single neutral arbitrator, in Broward County, Florida. The arbitrator shall not have the power to award punitive damages. Each party shall bear its own attorneys' fees unless the arbitrator finds a Dispute frivolous, in which case fees may be awarded to the prevailing party. No Disputes may be arbitrated on a class or representative basis. BY AGREEING TO THESE TERMS, YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR SIMILAR PROCEEDING, AND WAIVE YOUR RIGHT TO A JURY TRIAL. Judgment on an arbitration award may be entered in any court having jurisdiction.
Any matter not subject to arbitration shall be submitted to the state or federal courts located in Broward County, Florida, and all parties consent to personal jurisdiction there.
12. Privacy & Security
We maintain exclusive control over access to the Site/Services and reserve the right to revoke your access at any time, without notice, for any reason.
13. Links to Other Sites
The Site may contain links to third-party sites to which these Terms do not apply. We provide such links solely as a convenience; inclusion of a link does not imply our endorsement of or responsibility for that site's content. Use of linked sites is at your own risk.
